Actually it's not a raspiBackup issue but either a CIFS or rsync issue introduced in Bookworm and maybe some dependency on your CIFS server configuration. Everything works fine for me when I use my Synology as a CIFS server. Maybe it's also some CIFS server config which has to be updated.? I'm just guessing ...
